Successful case of representing a victim who reported a violation of the Child and Youth Sexual Protection Act (hierarchical adultery) due to sexual assault by a senior pastor.

The offender (appellant) was the client's pastor. The respondent was about 30 years older than the client, and over a period of five years, from when the client was a minor to when the client was an adult, the respondent engaged in dozens of unwanted sexual acts against the client, using force and sexual violence against the client. The client was so traumatized by the respondent's behavior that she attempted suicide on several occasions, and suffered physical harm that was difficult to recover from, resulting in extreme anxiety that prevented her from functioning in her daily life. The original prosecutor made a mechanical error of judgment by partially prosecuting and partially not prosecuting the same pattern of grooming sexual offenses over a number of years without clear criteria. The original prosecutor used the case hearing to clarify the nature of the hierarchy exercised by the respondent and the point at which it distorted the client's sexual decision-making, as well as the client's motivation for committing adultery.

The client consensually traveled to a motel to have sex with a woman he met through hunting, but when the woman's family was unable to reach the woman, they called 911 and used geolocation to raid the motel, where the client was charged with attempted rape. ■ Case Issues The client argued that although he had met the woman through hunting, they had a mutual attraction, exchanged phone numbers, talked, and consensually traveled to a motel, and that she was not intoxicated and incapacitated at the time. Ultimately, the issue in this case was whether the woman was incapacitated and whether the client intended to take advantage of this to commit adultery. ■ Resolving the issues The client's counsel quickly obtained motel surveillance footage, which confirmed that the woman had no problems walking, and showed the client and the woman actively making out before entering the motel. The client's counsel then argued that the woman was not incapacitated.
