Suspicion of filming and disseminating private images of a jilted lover, attempting to access personal information, etc.
Overview of the Case (Facts) After breaking up with his former girlfriend, the client was experiencing emotional difficulties and accidentally photographed her private parts without her consent and posted them online. He also attempted to access her personal information. After receiving a suspended prison sentence and a long-term employment restriction order at the first trial, the client approached Ongang Law Firm to prepare for an appeal, fearing severe punishment and social stigmatization. ■ Case Issues (Case Features) This was an appellate case, and it was important to vigorously argue that the sentence handed down in the first trial (especially the five-year work restriction order) was excessive (sentencing injustice). In the appeal, we emphasized favorable mitigating factors, such as the client's admission of all charges, his sincere remorse, and his willingness to settle amicably with the victim to avoid punishment, to maintain the probation but exempt the client from the work restriction order, which was critical to his job and livelihood.
