Overview of the case (facts)
The client was raped and injured by the defendant, whom she knew through an online game, on the same day she met him in person for the first time.
Even after the crime, the defendant posted insulting messages about the client to an unspecified number of people in an online chat room.
Our client came to us because she was unexpectedly victimized at a young age and suffered extreme emotional distress and confusion, not knowing how to cope.
Case Issues (Case Features)
The accused's offense was a gross sexual offense and violation of personhood against a minor client, and the accused denied committing the offense and sought to shift the blame to the client.
Assistance from Ongang
Our lawyers were able to resolve the client's injustice and ensure that the defendant was punished appropriately.
1. thorough evidence collection and analysis
In order to support our client's consistent statements, we carefully analyzed online conversations, including Instagram messages, Discord chat logs, and gaming site chat logs before and after the incident, and submitted them as evidence. In addition, we objectively proved the defendant's assault with the client's injury certificate.
2. Strengthen the credibility of victim statements
From the investigative phase through the trial, we helped our client organize and present a coherent and detailed account of his testimony, and helped him articulate the harm he experienced and the pain he suffered in court.
3. demonstrate the falsity of the accused's claims
The evidence and logic refuted the falsity of the accused's attempts to avoid the crime, including his claims that he did not know the client was underage, that the sex was consensual, and that the client accused him later. In particular, the evidence showed that the accused was aware of the client's age by submitting the client's school records to prove that the client was a normal and conscientious student, and by highlighting that the accused's insulting messages contained language indicating that the client was underage.
4. allege contempt
The defendant made insulting remarks about the client in an online chat room with an unspecified number of people, and the client detailed the shame and humiliation she felt as a result of the remarks, which made it clear that she was guilty of contempt.
5. severe penalties and ancillary sentences
Emphasizing that the defendant's crimes caused irreparable harm to the client, who was a minor, and that he did not show remorse after the crime, shifting the blame to the client and committing secondary harm, the court sought severe punishment for the defendant and additional orders, including completion of a sexual assault treatment program and restrictions on employment in related organizations.
■ Result
The court accepted Ongang Law Firm's arguments and found the defendant guilty of violating the Act on the Sexual Protection of Children and Adolescents (rape and sexual assault) and insult, and sentenced him to three years' imprisonment (statutory detention), completion of a 40-hour sexual assault treatment program, and employment restrictions for five years each in institutions related to children and adolescents and institutions related to persons with disabilities.
